The Democracy Fund (TDF) continues its Amish advocacy with further ticket reopenings and is now reviewing disclosure and awaiting trial dates.
TORONTO: The Democracy Fund (TDF) continues its Amish advocacy with another success. TDF lawyers have secured the reopening of cases for a fifth group of Amish clients who were charged under the Quarantine Act for issues related to the ArriveCan app and PCR testing. As a minority religious community that does not use electricity or modern conveniences, the Amish are particularly vulnerable to Quarantine Act-related government sanctions.
The legal team at TDF is currently reviewing the newly received disclosure from the Crown, with court dates expected to be scheduled shortly. This group includes a community elder whose modest living was jeopardized by multiple property liens associated with Quarantine Act convictions. By reopening these tickets, TDF's intervention has provided some hope that the crippling liens can be removed.
Despite these victories, the struggle for many continues. TDF's commitment extends to numerous other Amish clients still awaiting the reopening of their tickets, the vacating of liens, thorough review of disclosure, and the setting of trial dates. For every reopened case, TDF's legal team is prepared to go to trial to defend the rights of their clients.
Mark Joseph, TDF Litigation Director, remarked, "We are dedicated to seeking justice for these families. Having fought over 3500 of these COVID-era Quarantine Act tickets for other Canadians, it is our view that there is little to no public benefit in prosecuting these ones, especially when they threaten the land and livelihood of a peaceful minority religious group."
